Question: What is virgin land or soil and can I cultivate it?
Answer: Virgin land or soil means land that has not been cultivated for the last ten years.
You may NOT cultivate virgin land without written permission according to the Conservation of Agricultural Resources Act No. 43 OF 1983 (CARA).
Before you undertake to cultivate any new area you must first undertake an environmental impact assessment (EIA) according to the National Environmental Management Act (NEMA).

Question: What is a wetland and may I drain the water from it or cultivate it?
Answer: Wetland is a land area that is saturated with water, either permanently or seasonally.
No one may drain and/or cultivate any wetland, or do so within ten metres of the flood area of the wetland, without a permit. It is also unlikely that a permit will be granted to drain a wetland which is permanently saturated during normal rainfall season. Act (no 122 of 1984)
